Terms of Service & End User License Agreement

These terms govern your use of the fusion-events.ca website and the web applications and software operated by Fusion Events Inc. ("Fusion Events", "we", "us"), including interactive event experiences such as song request, voting, and photo applications (together, the "Services"). By using the Services you agree to these terms.
Use of the website
- Content on this site is provided for general information about our services.
- You agree not to misuse the site, interfere with its operation, or attempt unauthorized access.
- We may update, change, or discontinue any part of the site at any time.
End user license (event applications)
Fusion Events grants you a limited, non-exclusive, non-transferable, revocable license to use our web applications for their intended purpose at an event or as part of our services. You may not copy, modify, distribute, reverse engineer, or create derivative works from our software, or use it to build a competing product. All software, branding, designs, and content remain the exclusive property of Fusion Events Inc. and its licensors.
Content you submit through our applications (such as song requests, votes, display names, or photos) must not be unlawful, offensive, or infringe the rights of others. We may remove content and suspend access at our discretion to keep experiences safe and appropriate.
Event services
Event entertainment and production engagements are governed by a separate written agreement between Fusion Events and the client. If these terms conflict with a signed agreement, the signed agreement prevails.
Payments
Fees, deposits, and payment schedules for services are set out in each client agreement or invoice. Invoices may be issued and processed through third-party platforms such as Intuit QuickBooks, and credit card payments may be subject to a processing surcharge as disclosed at the time of billing.
Disclaimers and limitation of liability
The website and applications are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted availability. To the maximum extent permitted by law, Fusion Events Inc. is not liable for indirect, incidental, or consequential damages arising from use of the Services. Our total liability for any claim relating to the Services is limited to the amounts paid to us for the specific engagement giving rise to the claim.

Our collection and use of personal information is described in our Privacy Policy.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be resolved in the courts of Ontario.
